Terms of Service

The agreement that governs use of this website and purchases from WeCan Global America.

Effective Date: July 14, 2026 · Subject to any applicable written quotation or sales agreement

These Terms of Service ("Terms") govern your access to and use of the WeCan Global America website, including any dealer portal, forms, product information, quotation requests, orders, purchases, and related services made available through the website.

The website and the WeCan Global America brand are operated by Wizmozo LLC ("Wizmozo," "WeCan Global America," "we," "us," or "our").

WECAN GLOBAL CO., LTD., located in Iksan, Republic of Korea, is the manufacturer or supplier of certain products displayed on this website. Unless expressly identified as a contracting party in a separate written agreement, WECAN GLOBAL CO., LTD. is not the seller under these Terms.

By accessing the website, submitting a form, requesting a quotation, creating or using an account, or purchasing a product from us, you agree to these Terms. If you do not agree, you must not use the website or its services.

1. Eligibility and Authority

You must be legally capable of entering into a binding agreement.

If you use the website or place an order on behalf of a farm, company, dealership, government entity, municipality, cooperative, or other organization, you represent that you have authority to bind that organization to these Terms.

Our products are primarily intended for agricultural, commercial, professional, municipal, dealer, and business use.

2. Related Policies and Order of Precedence

These Terms incorporate our:

  • Shipping Policy
  • Return & Refund Policy
  • Warranty & Parts Policy
  • Privacy Policy
  • Legal Notice
  • Any accepted quotation, order confirmation, invoice, sales agreement, dealer agreement, or other written agreement issued by us

If there is a conflict, the following order applies:

  1. A separately signed sales, dealer, or distribution agreement
  2. The accepted quotation or written order confirmation
  3. The applicable invoice
  4. These Terms
  5. The general policies listed above

A specific written agreement controls only for the transaction or relationship it covers.

3. Website Information Is Not a Binding Offer

Product pages, specifications, images, videos, diagrams, estimated availability, compatibility tools, and other website content are provided for general information and sales-support purposes.

A product listing, quotation-request form, dealer form, or displayed product does not constitute a binding offer to sell, a reservation of inventory, or a guarantee of availability.

A request for quotation is not an order. A binding order is created only after:

  • We issue a written quotation, order confirmation, invoice, or sales agreement;
  • The customer accepts the applicable written terms; and
  • We receive any required deposit, payment, credit approval, or documentation.

We may decline a request or order before acceptance because of availability, pricing or specification errors, credit concerns, export restrictions, destination requirements, suspected fraud, or other legitimate business reasons.

4. Product Information and Specification Changes

We make reasonable efforts to provide accurate information. However, product specifications, dimensions, weights, colors, components, accessories, production details, model names, packaging, and availability may change without prior notice.

Photographs, renderings, diagrams, catalog images, and videos may show optional equipment, previous production versions, overseas configurations, prototype features, or products configured for a different market.

The final product configuration is the configuration identified in the accepted quotation, order confirmation, or sales agreement.

Minor manufacturing or component changes that do not materially reduce the stated function or performance of a product may occur. Any material substitution requires written customer approval.

5. Tractor Compatibility and Customer Information

Product recommendations may depend on information supplied by the customer, including:

  • Tractor manufacturer and model
  • Engine and PTO horsepower
  • PTO speed and shaft configuration
  • Three-point hitch category
  • Hydraulic capacity and connections
  • Tractor weight and lifting capacity
  • Tire configuration and clearance
  • Crop, acreage, soil, slope, and field conditions
  • Intended use and operating environment

The customer is responsible for providing complete and accurate information.

Our recommendations are based on the information provided and do not constitute an engineering certification or a guarantee of compatibility unless compatibility is expressly confirmed in writing for the specific tractor and product configuration.

The customer must confirm that the tractor and operating environment meet all applicable manufacturer requirements before use.

6. Pricing, Quotations, Taxes, and Fees

Prices displayed on the website, if any, may not include freight, taxes, duties, customs charges, brokerage, installation, assembly, unloading, dealer preparation, or destination-specific costs unless expressly stated.

A quotation is valid for the period stated in the quotation and may be withdrawn or revised before acceptance.

The customer is responsible for applicable sales, use, excise, import, customs, value-added, and similar taxes or governmental charges, except taxes imposed directly on our net income.

Tax-exempt customers must provide a valid exemption or resale certificate before the order is finalized.

We may correct clerical, mathematical, typographical, specification, freight, or pricing errors before accepting an order.

7. Payment

Payment terms are stated in the applicable quotation, invoice, or sales agreement.

We may require full payment, a deposit, financing approval, verified funds, or other payment security before production, release, shipment, or delivery.

Deposits and progress payments are refundable or nonrefundable only as stated in the applicable written quotation or sales agreement.

Payment processing may be provided by Shopify or other third-party payment providers. Those providers may apply their own terms, security procedures, and privacy practices.

The customer remains responsible for all authorized charges and amounts due under the applicable order.

8. Order Changes and Cancellation

An accepted order may not be changed or cancelled without our prior written approval.

Custom-configured products, special-order products, factory orders, products already in production, imported products, and products reserved or procured specifically for a customer may be non-cancellable.

If we approve a cancellation, the customer may be responsible for costs already incurred, including manufacturing, procurement, packaging, storage, administrative, freight, restocking, or cancellation charges, as stated in the applicable written agreement.

We may cancel an order if the product becomes unavailable, a material error is discovered, required payment is not received, the customer fails to provide necessary information, or fulfillment would violate applicable law.

9. Shipping and Delivery

Shipping methods, freight charges, delivery terms, and estimated timing are confirmed for each order.

Products may ship by parcel carrier, pallet, crate, less-than-truckload freight, full truckload, flatbed, ocean freight, or another method appropriate for the product and destination.

Delivery and production dates are estimates unless expressly guaranteed in a signed written agreement.

We are not responsible for delays caused by carriers, port congestion, customs processing, weather, road conditions, labor disruptions, material shortages, government action, incorrect delivery information, or events outside our reasonable control.

Additional charges may apply for:

  • Residential or rural delivery
  • Limited-access locations
  • Liftgate service
  • Delivery appointments
  • Redelivery
  • Storage
  • Address correction
  • Detention or waiting time
  • Special permits
  • Oversize handling
  • Inside delivery or placement
  • Customs, brokerage, or port handling

10. Delivery Access and Unloading

The customer must provide a safe, legal, and accessible delivery location.

Unless otherwise agreed in writing, the customer is responsible for providing appropriate unloading equipment and qualified personnel, which may include a forklift, loading dock, tractor with forks, crane, telehandler, or other equipment suitable for the shipment.

The carrier and driver may refuse unsafe unloading conditions.

Costs resulting from inaccessible delivery locations, unavailable unloading equipment, customer delay, failed delivery, or redelivery may be charged to the customer.

11. Title and Risk of Loss

Title and risk of loss transfer according to the delivery terms stated in the accepted quotation, invoice, or sales agreement.

If no separate delivery term is stated, title and risk of loss pass to the customer when the product is tendered to the carrier after the required payment has been received, subject to applicable law.

This provision does not eliminate any valid claim for concealed damage, carrier liability, or rights that cannot lawfully be waived.

12. Delivery Inspection and Freight Damage

The customer must inspect the shipment at delivery.

Visible damage, shortage, missing crates, broken packaging, or other delivery concerns should be:

  • Noted on the carrier’s delivery receipt or Bill of Lading before signing;
  • Photographed before unloading or removing packaging; and
  • Reported to us promptly with the delivery documents and photographs.

Signing a delivery receipt without noting visible damage may affect the ability to pursue a carrier claim.

Concealed damage should be documented and reported as soon as reasonably possible after discovery.

We may assist with a freight claim, but assistance does not mean that we accept responsibility for damage occurring after risk of loss has transferred.

13. Returns and Refunds

No product may be returned without prior written return authorization.

Return eligibility, return condition, restocking charges, return freight, inspection, credit, and refund timing are governed by our Return & Refund Policy and the applicable written sales agreement.

Custom-configured products, special orders, used products, installed products, electrical or hydraulic components, and products damaged after delivery may be non-returnable unless otherwise approved in writing.

Unauthorized returns may be refused, stored at the customer’s expense, or returned to the customer.

14. Limited Warranty and Parts Support

Warranty coverage, claim procedures, exclusions, remedies, labor responsibility, and freight responsibility are governed exclusively by the written Warranty & Parts Policy, the applicable warranty registration, and the applicable sales agreement.

Warranty service requires prior written authorization.

The customer must not discard, modify, repair, ship, or replace a suspected defective component before receiving authorization if reimbursement or warranty coverage is requested.

No dealer, employee, contractor, representative, or third party may modify a written warranty unless the modification is approved in writing by an authorized representative of Wizmozo LLC.

15. Disclaimer of Warranties

EXCEPT FOR AN EXPRESS WRITTEN LIMITED WARRANTY OR OTHER EXPRESS WARRANTY INCLUDED IN AN APPLICABLE SALES AGREEMENT, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, SERVICES, PRODUCT INFORMATION, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.

NO ORAL STATEMENT, WEBSITE DESCRIPTION, SALES PRESENTATION, COMPATIBILITY TOOL, PHOTOGRAPH, VIDEO, OR CATALOG CREATES A WARRANTY UNLESS IT IS EXPRESSLY INCLUDED IN A WRITTEN AGREEMENT AUTHORIZED BY US.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS A WARRANTY, REMEDY, OR STATUTORY RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

16. Safe Operation

Agricultural machinery and tractor implements can cause serious injury, death, or property damage if transported, installed, adjusted, maintained, or operated improperly.

Before use, the owner and operator must:

  • Read and follow the applicable operator’s manual;
  • Follow all safety labels, warnings, and maintenance instructions;
  • Use appropriate guards, shields, PTO protection, and personal protective equipment;
  • Confirm proper tractor ballast, hitching, PTO speed, hydraulic connections, and lifting capacity;
  • Keep bystanders clear;
  • Comply with applicable workplace, road, transport, environmental, and equipment-safety requirements; and
  • Ensure that operation, maintenance, and repair are performed by qualified persons.

Products must not be modified, welded, bypassed, overloaded, or used outside their intended purpose without written manufacturer approval.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIZMOZO LLC, WECAN GLOBAL AMERICA, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, SUPPLIERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

THIS INCLUDES LOSS OF CROPS, LOSS OF YIELD, LOSS OF REVENUE, LOSS OF PROFIT, LOSS OF USE, BUSINESS INTERRUPTION, DOWNTIME, RENTAL EQUIPMENT, SUBSTITUTE MACHINERY, LABOR COSTS, DELAY COSTS, OR LOSS OF DATA, EVEN IF THE POSSIBILITY OF SUCH LOSS WAS KNOWN.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO US FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

These limitations do not apply to fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited.

18. Customer Misuse and Indemnification

To the extent permitted by law, the customer agrees to defend, indemnify, and hold harmless Wizmozo LLC and its owners, employees, contractors, suppliers, and affiliates from third-party claims resulting from:

  • Customer misuse or unsafe operation;
  • Unauthorized modification or repair;
  • Operation outside the product’s intended purpose;
  • Failure to follow manuals, warnings, or applicable law;
  • Inaccurate compatibility, delivery, or export information supplied by the customer; or
  • Customer resale, rental, installation, or distribution of a product in violation of an agreement or law.

This section does not require indemnification for our own gross negligence, fraud, or willful misconduct.

19. Dealers, Resellers, and Distributors

Submitting a dealer application, accessing dealer materials, purchasing for resale, or discussing a territory does not appoint a person or company as an authorized dealer, distributor, agent, franchisee, or exclusive representative.

Dealer status, territory, pricing, marketing rights, resale authority, and exclusivity exist only under a separate written agreement signed by an authorized representative of Wizmozo LLC.

No dealer or reseller may make warranties, representations, or commitments on our behalf unless expressly authorized in writing.

20. Exports and International Orders

International sales may be subject to export controls, import requirements, customs rules, sanctions, local equipment standards, taxes, duties, registration, labeling, and documentation requirements.

Unless otherwise agreed in writing, the customer is responsible for acting as importer of record and for determining whether the product may lawfully be imported, registered, transported, sold, and used at the destination.

The customer must not purchase, export, re-export, transfer, or use a product in violation of applicable United States or destination-country laws.

We may decline or suspend a transaction when required information is unavailable or when we reasonably believe that fulfillment may violate applicable law.

21. Dealer Portal and Account Security

Dealer and restricted-access accounts are personal to the approved user or organization.

Users must maintain the confidentiality of passwords, pricing, dealer documents, technical materials, and other restricted information.

Accounts may not be shared, transferred, scraped, copied, or used by unauthorized persons.

We may suspend or terminate access because of security concerns, false information, misuse, inactivity, violation of an agreement, or loss of approved dealer status.

22. Intellectual Property

The website and its content, including text, photographs, product images, videos, graphics, logos, trademarks, specifications, documents, page layouts, and downloadable materials, are owned by or licensed to Wizmozo LLC, WECAN GLOBAL CO., LTD., or their respective licensors.

We grant users a limited, revocable, non-exclusive right to access the website for legitimate informational and purchasing purposes.

No website content may be copied, republished, modified, sold, scraped, distributed, reverse engineered, or used commercially without prior written permission.

References to third-party tractor or equipment brands are for compatibility or informational purposes only. Those marks belong to their respective owners.

23. Prohibited Uses

You may not use the website to:

  • Violate any law or third-party right;
  • Submit false, misleading, fraudulent, or impersonated information;
  • Introduce malware, harmful code, or unauthorized automated access;
  • Interfere with website security or operation;
  • Scrape product data, dealer information, pricing, images, or technical materials;
  • Attempt to gain unauthorized access to accounts or systems;
  • Misrepresent an affiliation, dealership, authorization, or product warranty; or
  • Use website content to create counterfeit, copied, or misleading products or materials.

24. Third-Party Services and Links

The website may use or link to services operated by Shopify, payment providers, carriers, manufacturers, map providers, social platforms, or other third parties.

We do not control all third-party services and are not responsible for their independent terms, availability, security, content, or privacy practices.

Use of a third-party service may be subject to that provider’s separate terms.

25. Privacy

Personal information is collected, used, shared, and retained as described in our Privacy Policy.

By submitting information through the website, you confirm that the information is accurate and that you are authorized to provide it.

26. Force Majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic, war, terrorism, civil disturbance, labor disruption, government action, sanctions, port closure, carrier interruption, utility failure, cyberattack, material shortage, factory interruption, or transportation disruption.

Affected obligations will be suspended for the duration of the event. If performance becomes commercially impracticable for an extended period, either party may exercise any cancellation rights stated in the applicable written agreement.

27. Suspension and Termination

We may restrict, suspend, or terminate website, dealer-portal, or account access when we reasonably believe there has been fraud, misuse, a security threat, nonpayment, violation of these Terms, or unlawful activity.

Termination does not eliminate payment obligations, confidentiality duties, intellectual-property restrictions, warranty procedures, limitations of liability, or other provisions intended to survive termination.

28. Governing Law and Venue

These Terms and any transaction with Wizmozo LLC are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Except where prohibited by applicable law or changed by a separately signed agreement, disputes must be brought in the state or federal courts having jurisdiction in Harris County, Texas.

Each party consents to the jurisdiction of those courts.

29. International Users and Language

Users outside the United States are responsible for complying with applicable local law.

Nothing in these Terms removes rights that cannot lawfully be waived under the law applicable to a particular customer or transaction.

If these Terms are translated, the English version controls to the extent permitted by applicable law unless a signed written agreement expressly states otherwise.

30. Changes to These Terms

We may update these Terms to reflect changes in law, products, services, technology, or operating procedures.

The revised Terms become effective when posted with a new effective date.

A change to website Terms does not retroactively modify an already accepted quotation, order, warranty, or sales agreement unless the parties agree in writing or applicable law requires otherwise.

31. General Terms

If any provision is found unenforceable, the remaining provisions remain effective.

Failure to enforce a provision is not a waiver of that provision.

The customer may not assign an accepted order or these Terms without our prior written consent. We may assign our rights and obligations as part of a merger, reorganization, sale of business assets, financing, or transfer to an affiliate or successor.

These Terms and the applicable written transaction documents constitute the entire agreement concerning their subject matter and replace prior discussions or representations concerning that subject matter.

Headings are for convenience only and do not limit interpretation.

These Terms may be updated as our products, services, and operating procedures evolve. An accepted quotation, order, or sales agreement is governed by the terms in effect when it was accepted.
